These Terms and Conditions govern your use of our website and any purchase from Nervan Health ("we", "us", "our"), operated by Nervan Health, contact: theunderground226@gmail.com. By placing an order you confirm you have read and agreed to these Terms and to our Shipping, Refund and Return, and Cancellation policies.
1.1 Who we are and how we fulfil orders
We are an online retailer. Products are sourced from third-party manufacturers and suppliers and shipped directly to you from overseas warehouses, typically in China. This means delivery takes longer than domestic shipping, orders may arrive in separate parcels, and packaging may not carry our branding.
1.2 Orders and contract
Your order is an offer to buy. A contract is formed only when we send you an order confirmation email and begin processing. We may decline or cancel any order, for example due to stock issues, pricing errors, suspected fraud, or inability to verify your details, and will refund you in full if we do.
1.3 Prices and payment
Prices are in AUD and include GST where applicable. Payment is taken at checkout through our payment providers. You confirm you are the authorised holder of the payment method used. We may request identity or payment verification before shipping and may cancel unverified orders.
1.4 Product information
We describe products as accurately as we can. Colours may vary slightly because of screen settings, and measurements may vary by a small tolerance (typically up to 1–3 cm) because of manufacturing. Minor variations of this kind are not a defect.
1.5 Accurate details
You are responsible for entering a correct, complete and deliverable shipping address and a working email and phone number. We are not liable for loss, delay or extra charges caused by incorrect or incomplete details supplied by you.
1.6 Customs, duties and taxes
Where applicable, import duties, taxes or customs clearance fees are the buyer's responsibility unless stated at checkout. Refusing to accept or pay for a parcel does not entitle you to a refund of the product price or shipping.
1.7 Use of the product
You are responsible for using products according to any instructions and for checking suitability, compatibility and legal use in your location before purchase. We are not liable for loss or damage arising from misuse, modification, or use contrary to instructions.
1.8 Disputes and chargebacks
If you have a problem with an order, please contact us at theunderground226@gmail.com first. We respond within 2 business days and will work to resolve it. By purchasing, you agree to contact us and allow us a reasonable opportunity to resolve your issue before lodging a dispute or chargeback with your bank or card issuer. We retain and may submit as evidence to your bank and payment processor: your order confirmation, the details and IP address used at checkout, your acceptance of these policies, shipping and tracking records, proof of delivery, and our correspondence with you. Filing a dispute for an order that was delivered as tracked, or that is covered by these policies, without first contacting us may be treated as an abuse of the dispute process, and we may refuse future orders.
1.9 Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability for any claim relating to an order is limited to the price you paid for that order.
1.10 Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits those rights.
1.11 Intellectual property
All content on this site, including text, images and logos, belongs to us or our licensors. You may not copy or reuse it without written permission.
1.12 Privacy
We collect and use your personal information as described in our Privacy Policy. Your details are shared with our suppliers, shipping carriers and payment providers only as needed to complete your order.
1.13 Changes and governing law
We may update these Terms at any time. The version in force when you place your order applies to that order. These Terms are governed by the laws of New South Wales, Australia.
